NO PURCHASE IS NECESSARY. ONE ENTRY IS ALLOWED PER PERSON. Each person entering or registering is considered an “entrant.” Void where prohibited by law. This Promotion is subject to all federal, state, provincial and local laws.
This Promotion begins on July 01.2015 and ends on September 30, 2015 (the "Promotional Period"). All times Eastern time zone. Odds of winning the Grand Prize will depend on the number of entries received.
ELIGIBILITY: This Promotion is open to all legal residents of the United States and Canada (excluding Puerto Rico) who are twenty-one (21) years of age or older, and who have agreed to be bound by these Official Rules. Participation in this Promotion constitutes entrant's full and unconditional acceptance of these Official Rules. Employees, officers and directors and their immediate families (parents, brothers, sisters and children, regardless of where they reside) of the Sponsor, its subsidiaries and affiliated businesses and their advertising and promotional agencies are not eligible to enter or win.
METHODS OF ENTRY: There are two ways to enter: (1) By participating in a demonstration of our Eagle N Series® software (which is approximately 30-60 minutes); or (2) Submit the following information: name, company name, mailing address, phone number, and email address on a 3x5 inch card, postage pre-paid and mailed to: Epicor Software, 4120 Dublin Blvd. Suite 300, Dublin, CA 94568, Attn C.Metzger. All entries must be post-marked by midnight of the last day of the Promotion Period. Only one (1) entry is permitted for entry method 2. All entries become the sole property of the Sponsors and none will be returned for any reason. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, falsified, altered, garbled, mechanically or electronically reproduced, or tampered with in any way.
PRIZE: One (1) Grand Prize: One GoPro® HERO Camera (Total Value: $130.00). Winner is responsible for all federal, state, provincial and local taxes associated with acceptance and use of prize. Prize is not transferable. No substitution of prize permitted except at Epicor’s option.
DRAWING AND PRIZE REDEMPTION: The Grand Prize Winner will be selected from all eligible entries received in a random drawing at the Epicor office at 4120 Dublin Blvd. Suite 300, Dublin, CA 94568 on or about the tenth (10) business day after the end of the Promotional Period. Epicor will notify the potential winner by telephone and check eligibility. If you are a resident of Canada, you may be required to answer a mathematical question. Epicor will deliver the prize within ten (10) business days of determining the Grand Prize Winner. Awarding of prize will be conducted by Epicor, whose decisions are final and binding on all matters relating to the Promotion. The name of the Grand Prize Winner will be available by writing to: Epicor Software, 4120 Dublin Blvd. Suite 300, Dublin, CA 94568, Attn C.Metzger.
LIABILITY & WAIVER: THIS PROMOTION AND THE GRAND PRIZE ARE PROVIDED “AS IS” WITHOUT ANY WARRANTY AND ALL WARRANTIES ARE DISCLAIMED. By participating, each entrant agrees that Epicor, its parent, subsidiaries, affiliated businesses, advertising and promotion agencies and the officers, directors, employees and agents of each, are not responsible or liable (however named or described) for injuries, damages, or losses to persons or property which may be caused or sustained in connection with registering, ENTERING or participating in the promotion, or the receipt, enjoyment, ownership or use of the prize. Except where prohibited by law, including without limitation for residents of Tennessee, by entering the winner grants permission to Epicor to use the winner's name, age, city, state/PROVINCE, photograph or likeness for advertising and promotional purposes without additional compensation, NOTICE or approval.
Epicor is not responsible for lost or misdirected entries; entries not received due to difficulty accessing the internet, service outages or delays, technical difficulties; or illegible, corrupted or untimely entries, which are void. All entries become the sole property of Epicor and will not be acknowledged or returned. If a dispute arises as to any online entry, the entrant will be deemed to be the authorized account holder of the e-mail address, if any, used to enter. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the registered user of the email account. If the Promotion is not capable of running as planned for any reason that affects its administration, security, fairness or integrity, Epicor reserves the right to cancel, modify or suspend the Promotion without prior notice or obligation to any entrant or third party, or to select a potential winner from all eligible entries received up to the date of cancellation, modification or suspension.
DISPUTES: Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any prize awarded, shall be subject to the laws of the state of California and shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of California; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Epicor in connection with the Promotion, shall be governed by, and construed in accordance with the laws of the state of California without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
