This promotion (“Promotion”) is sponsored by Epicor Software Corporation (“Epicor”) with its corporate headquarters located at 804 Las Cimas Parkway, Austin, Texas 78746.
NO PURCHASE IS NECESSARY. ONE ENTRY IS ALLOWED PER PERSON. Each person entering or registering is considered an “entrant.” Void where prohibited by law. This Promotion is subject to all federal, state, provincial and local laws.
This Promotion begins on September 12, 2016 and ends on September 17, 2016 (the "Promotional Period"). All times Central time zone. Odds of winning the Grand Prize will depend on the number of entries received.
This Promotion is open to all legal residents of the United States and Canada (excluding Puerto Rico) who are twenty-one (21) years of age or older, and who have agreed to be bound by these Official Rules. Participation in this Promotion constitutes entrant's full and unconditional acceptance of these Official Rules. Employees, officers and directors and their immediate families (parents, brothers, sisters and children, regardless of where they reside) of the Sponsor, its subsidiaries and affiliated businesses and their advertising and promotional agencies are not eligible to enter or win.
There are two ways to enter: (1) By participating in demo of Epicor Software products or (2) Submit the following information: name, company name, mailing address, phone number, and email address on a 3x5 inch card, postage pre-paid and mailed to: 600 Hwy 169, Suite 2000, Minneapolis MN 55426. All entries must be post-marked by midnight of the last day of the Promotion Period. Only one (1) entry is permitted for entry method 2. All entries become the sole property of the Sponsors and none will be returned for any reason. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, falsified, altered, garbled, mechanically or electronically reproduced, or tampered with in any way.
One (1) Grand Prize: Yeti Tundra 45 cooler (Total Value: $349.99). Winner is responsible for all federal, state, provincial and local taxes associated with acceptance and use of prize. Prize is not transferable. No substitution of prize permitted except at Epicor’s option.
The Grand Prize Winner will be selected from all eligible entries received in a random drawing on or about the tenth (10) business day after the end of the Promotional Period. Epicor will notify the potential winner and check eligibility. If you are a resident of Canada, you may be required to answer a mathematical question. Epicor will have the prize delivered within 30 days of determining the winner. Epicor decisions are final and binding on all matters relating to the Promotion. Epicor is not responsible for lost or misdirected entries; entries not received due to difficulty accessing the internet, service outages or delays, technical difficulties; or illegible, corrupted or untimely entries, which are void. All entries become the sole property of Epicor and will not be acknowledged or returned. If a dispute arises as to any online entry, the entrant will be deemed to be the authorized account holder of the e-mail address, if any, used to enter. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Potential winners may be required to show proof of being the registered user of the email account. If the Promotion is not capable of running as planned for any reason that affects its administration, security, fairness or integrity, Epicor reserves the right to cancel, modify or suspend the Promotion without prior notice or obligation to any entrant or third party, or to select a potential winner from all eligible entries received up to the date of cancellation, modification or suspension.
Each entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Promotion, or any prize awarded, shall be subject to the laws of the state of Texas and shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Texas; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Epicor in connection with the Promotion, shall be governed by, and construed in accordance with the laws of the state of Texas without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
